These Website Terms of Use (“Terms”) govern access to and use of the website located at trustpadel.com (the “Platform”), operated by Trust Padel LTD, by any visitor, registered user, player, coach, or member of the public (“User”, “you”, or “your”).

These Terms apply to your general use of the Platform as a User. They do not apply to businesses purchasing or holding a paid listing on the Platform, whose relationship with Trust Padel LTD is instead governed by our separate Listing Terms & Conditions (see clause 19).

By accessing, browsing, registering on, or otherwise using the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must stop using the Platform.

References to “Trust Padel”, “we”, “us”, or “our” mean Trust Padel LTD.

2. Definitions and interpretation

In these Terms:

• User / You / Your means any individual who accesses, browses, registers on, or otherwise uses the Platform other than as a paying Client under the Listing Terms & Conditions.
• Platform means the Trust Padel website located at trustpadel.com, together with its databases, tools, directories, and related digital services.
• Listed Business means any padel club, retailer, industry participant, coach, or other business or venue that appears on the Platform, whether under a paid listing or a free entry.
• Listing Terms & Conditions means Trust Padel's separate terms governing paid listings purchased by Clients, available on the Platform.
• User Content means reviews, ratings, comments, posts, messages, or other material that you submit to or through the Platform.
• Account means a registered user profile created on the Platform, where registration is offered.

Headings are for convenience only and do not affect interpretation.

3. Nature of the Platform

Trust Padel operates a discovery and information platform for padel-related venues, businesses, and activity, including a directory, search tools, rankings, community features, news, and related content.

The Platform is provided for informational and discovery purposes only. Trust Padel is not a booking agent, payment processor, broker, or intermediary for any Listed Business, and does not process bookings, payments, or transactions between Users and Listed Businesses unless expressly stated otherwise on the Platform.

Trust Padel does not verify, guarantee, or endorse the accuracy, quality, safety, or legality of any Listed Business, and inclusion of a Listed Business on the Platform is not a recommendation or endorsement by Trust Padel.

Use of the Platform does not create any partnership, agency, employment, or joint venture between you and Trust Padel.

4. Eligibility

You may use the Platform only if you are able to form a legally binding contract and are at least 18 years old. The Platform is not intended for use by, and we do not knowingly permit registration or use by, anyone under 18.

If you use the Platform on behalf of a business or organisation, you confirm that you have authority to bind that entity to these Terms.

You must provide accurate information when using any feature of the Platform that requests it, including when creating an Account, submitting a review, or registering a business.

5. Accounts

Certain features (for example, saving venues, submitting reviews, or participating in community features) may require you to register for an Account.

You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account.

You must notify us promptly at hello@trustpadel.com if you become aware of any unauthorised use of your Account.

We may suspend or close an Account in accordance with clause 15.

6. Directory content and third-party businesses

Information about Listed Businesses (including venue details, pricing, availability, images, and contact details) is supplied by the relevant business or compiled by Trust Padel from publicly available sources, and may not always be complete, current, or accurate.

Any booking, purchase, membership, or other arrangement you enter into with a Listed Business is strictly between you and that business. Trust Padel is not a party to that arrangement and accepts no responsibility for its performance.

You are responsible for carrying out your own checks on any Listed Business before engaging with it, including in relation to licensing, safety, and suitability.

If you believe information about a Listed Business is inaccurate or inappropriate, please report it to hello@trustpadel.com.

7. User content

Where the Platform allows you to submit User Content (such as reviews, ratings, or community posts), you retain ownership of that content.

By submitting User Content, you grant Trust Padel a non-exclusive, royalty-free, worldwide, sub-licensable licence to host, store, reproduce, display, adapt, and distribute that content in connection with operating and promoting the Platform.

You warrant that your User Content: is accurate and not misleading; reflects your genuine experience where presented as a review; does not infringe any third party's intellectual property, privacy, or other rights; and is not unlawful, defamatory, obscene, threatening, or harassing.

Trust Padel may, but is not obliged to, moderate, edit, refuse, or remove any User Content at its discretion, including where it breaches these Terms or is reported by a third party.

You are solely responsible for your User Content and for ensuring you have the right to submit it.

8. Acceptable use

You must not use the Platform to:

• Submit false, misleading, or fraudulent reviews or content;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Scrape, harvest, or extract data from the Platform other than through features provided for that purpose;
• Introduce viruses, malware, or other harmful code, or attempt to gain unauthorised access to the Platform or its systems;
• Harass, abuse, defame, or threaten any other User or Listed Business;
• Breach any applicable law or third-party right; or
• Interfere with the proper functioning of the Platform.

9. Intellectual property

Trust Padel owns or licenses all rights in the Platform, including its design, software, databases, compilation, trademarks, logos, and branding (excluding User Content and Listed Business content, which remain owned by the relevant contributor).

You may access and use the Platform for your own personal, non-commercial use. You must not copy, reproduce, republish, scrape, or exploit any part of the Platform for commercial purposes without our prior written consent.

10. Platform availability and changes

Trust Padel aims to keep the Platform available but does not guarantee uninterrupted or error-free access.

We may modify, suspend, or discontinue any feature or part of the Platform at any time, including for maintenance, security, or business reasons.

We are not liable for any loss you suffer as a result of the Platform, or any part of it, being unavailable at any time.

11. Disclaimers

The Platform, and all content on it, is provided “as is” and “as available” without warranties of any kind, whether express or implied.

Trust Padel makes no warranty that the Platform will meet your requirements, that information about Listed Businesses is accurate or current, or that use of the Platform will lead to any particular outcome (including bookings, leads, or business for Listed Businesses).

12. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

Subject to clause 12.1, to the maximum extent permitted by law, Trust Padel shall not be liable for any loss of profits, revenue, data, or goodwill, or for any indirect or consequential loss, arising from your use of the Platform.

Subject to clause 12.1, and because the Platform is provided to Users free of charge, Trust Padel's total liability to you in connection with your use of the Platform shall not exceed £100.

Trust Padel is not liable for the acts, omissions, products, or services of any Listed Business.

13. Indemnity

You agree to indemnify and hold harmless Trust Padel against all claims, losses, damages, and expenses arising from your breach of these Terms, your User Content, or your misuse of the Platform.

14. Data protection

Trust Padel will process your personal data in accordance with UK GDPR and applicable data protection law, and as described in our Privacy Policy, available on the Platform.

The Platform may use cookies and similar technologies as described in our Cookie Policy.

15. Suspension and termination

You may stop using the Platform, or close your Account, at any time.

We may suspend or terminate your access to the Platform (including any Account), or remove any User Content, immediately and without notice if you breach these Terms, if we reasonably suspect fraudulent, unlawful, or harmful conduct, or where necessary to protect the Platform, other Users, or Listed Businesses.

Clauses which by their nature are intended to survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) shall continue to apply.

16. Third-party links

The Platform may contain links to third-party websites, including those of Listed Businesses. We do not control and are not responsible for the content, policies, or practices of any third-party website.

17. Force majeure

Neither party shall be liable for any failure or delay in performance caused by events beyond its reasonable control.

18. Sponsors and partners

The Platform may display sponsored content, advertising, or partner promotions. These are clearly identified where required by law and do not constitute an endorsement by Trust Padel of the relevant sponsor's products or services. Any separate commercial arrangement with a sponsor or partner is governed by that party's individual agreement with Trust Padel, not by these Terms.

19. Relationship with other Trust Padel terms

If you are a business that purchases or holds a listing on the Platform, our Listing Terms & Conditions apply to that listing and, to the extent of any conflict regarding the listing, take precedence over these Terms.

If you register a business or venue on the Platform under any other arrangement (for example, a free directory entry or a map-layer listing), the specific terms presented to you at the point of registration apply in addition to these Terms.

Our Privacy Policy and Cookie Policy are incorporated into these Terms by reference.

20. Changes to these Terms

These Terms may be updated from time to time to reflect changes to the Platform, legal requirements, or our business operations.

The latest version will always be available on the Platform and will display the “Last updated” date.

Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

21. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
